The following Terms and Conditions (“Terms”) between you (“you” or “your”) and THE NIFTY PANTRY (PTY) LIMITED (“we,” “our,” “us,” or “THE NIFTY PANTRY”) describe the terms and conditions on which you may access and use THE NIFTY PANTRY website located at www.theniftypantry.co.za (the “Site”). By accessing or using any of the Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

PLEASE READ THESE TERMS CAREFULLY.  BY CLICKING “I ACCEPT TERMS AND CONDITIONS” OR OTHERWISE ACCESSING OR USING ANY PART OF THE SERVICES, YOU AGREE TO THESE TERMS.

All aspects of this website (copy, imagery, code, and tools) are copyrighted under the South African law and other relevant copyright laws.

TRADEMARKS
All trademarks, service marks and trade names of THE NIFTY PANTRY used on this website and other social media platforms are registered trademarks of THE NIFTY PANTRY.

USER REPRESENTATIONS
By using the Site, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information and promptly update such registration information as necessary; (3) you have the legal capacity and you agree to comply with these Term of Use; (4) you are not a minor in the jurisdiction in which you reside; (5) you will not access the Site through automated or non-human means, whether a bot, script or otherwise; (6) you will not use the Site for any illegal or unauthorized purpose; and (7) your use of the Site will not violate any applicable law or regulation.

If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Site (or any portion thereof).

ELIGIBILITY
You must be the legal age of 18 years to access this website. Upon accessing this website, you certify that you are at least 18 years old.

By clicking and agreeing to these Terms, you represent that you are 18 years or older and that you are authorized to use the chosen payment method (including, without limitation, credit cards) for the purpose of renting the Products as described in these Terms.

PRODUCTS
THE NIFTY PANTRY gives you access to luxury tablescapes to be used for a specific rental period.

We make every effort to display as accurately as possible the colours, features, specifications, and details of the products available on the Site. However, we do not guarantee that the colours, features, specifications, and details of the products will be accurate, complete, reliable, current, or free of other errors, and your electronic display may not accurately reflect the actual colours and details of the products. All products are subject to availability, and we cannot guarantee that items will be in stock. We reserve the right to discontinue any products at any time for any reasons. Prices for all products are subject to change.

LIMITS
We reserve the right to refuse any order placed through the Site for any reason. We may, in our sole discretion, limit or cancel quantities rented/purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same payment method, and/or orders that use the same billing or shipping address. We reserve the right to limit or prohibit orders that, in our sole judgement appear to be placed by dealers, resellers, or distributors.

FEES / CHARGES
The rental fee for any Product will be the total of the rental fee and delivery charges listed on the Site for your rental of the Product. You hereby authorize THE NIFTY PANTRY to charge your payment card for the full amount immediately upon your rental order. A reservation of a Product on the Site is an order for the rental of that Product, regardless of how far in advance that Product is reserved.

In addition, at the time of your rental order for a Product, you hereby authorize THE NIFTY PANTRY to charge your payment card for an amount equal to 100% of the rental fee; provided that THE NIFTY PANTRY will only charge your payment card for an amount greater than the Rental Fee as described below (Specific Rental Conditions).

PAYMENT
You agree to pay all charges at the prices for your rentals/purchases and any applicable delivery fees, and you authorize us to charge your chosen payment provider for any such amounts upon placing your order.

You agree to provide current complete, and accurate purchase and account information for all purchases made via the Site. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed. VAT will be added to price of rentals/purchases as deemed required by us. All payments shall be in South African Rands (ZAR).

We accept the following forms of payment:

• Visa
• Mastercard
• EFTs (Electronic Fund Transfers)

The rental booking will be confirmed, in writing by THE NIFTY PANTRY, once full payment has been received.

CANCELLATION POLICY
All cancelations must be made in writing to sales@theniftypantry.co.za. Your payment will be refunded as follows:

• 100% full refund if you cancel 14 days or more before your event date.
• 50% of your amount paid if you cancel 7 days before your event date.
• 0% (NO REFUND) if you cancel 6 days or fewer in advance of the event date.

However, you can modify your order 48 hours before scheduled pick-up or delivery date. Changes are subject to availability and the price may vary.

DELIVERY
THE NIFTY PANTRY delivers nationwide, door-to-door.  All deliveries will be made by a representative of THE NIFTY PANTRY or through THE NIFTY PANTRY's delivery partner.

Customers are responsible for providing a secure and valid delivery address at checkout. Products cannot be left without an individual physically providing a signature and proof of identification.

THE NIFTY PANTRY will not bear liability for delivery delays or return packages to us undeliverable.

If an error was made at checkout, THE NIFTY PANTRY must be informed immediately at sales@theniftypantry.co.za.

COLLECT / RETURNS
The Customer may collect and return (by appointment) items free of charge in Sunninghill, Johannesburg.

CORRECT PRODUCTS
We will deliver the Products you ordered, including the specified quantity and design, on or before the delivery date for which you ordered them, except in the rare event that the Product is damaged beyond repair or is otherwise unavailable. In such event, we will use reasonable efforts to notify you that the Product is unavailable. If we can reach you, you will be entitled to choose any available rental Product to replace the unavailable Product. If we are unable to reach you, you acknowledge and agree that we may send you a replacement product of the same or greater value. Products may appear different in colour and style than as displayed on the Site.

CLEAN AND READY TO USE
The Products will be professionally cleaned and delivered ready to use. THE NIFTY PANTRY inspects and sanitizes each Product with the utmost care, but use of the Product is at your own risk and THE NIFTY PANTRY shall not be held liable for any health-related complaints associated with any Product.

USE OF THE PRODUCTS
By renting Products from THE NIFTY PANTRY, you agree that it is for a legitimate purpose and not to engage in unfair and/or illegal business activities or competition.

Our collection includes fragile items and breakables. The Customer is responsible for taking extra care when handling the rental items, including informing others (i.e., guests, venue) of this, to prevent breakages or damage to items.

When packing the sets for return, please ensure all pieces of food are removed from the plates, and any liquid or juices are drained away.

DAMAGED / LOST ITEMS
You are responsible for loss, destruction, or damage to the Products due to theft, mysterious disappearance, fire, major stains or any other cause, other than normal wear and tear. Normal wear and tear encompass minor stains, scratches, or other minor damage that is easily and inexpensively repaired. If you return a Product that is damaged beyond normal wear and tear, then you agree that we shall charge you, and you shall pay, for the price for repairing or replacing the Product as listed below:

R 500 per each damaged / lost tablecloth or runner
R 500 per each damaged / lost centre piece
R 150 per each damaged / lost dish, plate or under plates
R 150 per each damaged / lost glassware
R 100 for each damaged / lost candle holder
R  50 per each damaged / lost napkin ring
R 500 for The Nifty Pantry delivery box

RETURN PACKAGING
All rental items supplied by THE NIFTY PANTRY are packaged carefully to restrict movement in order to protect against breakage or damage during transit. The Customer is required to ensure the rental items are packed as they were supplied and are safe for transit, including using the packaging material (foam, bubble wrap) and containers supplied. Any loss or damage to the packaging material or containers supplied will be charged at replacement value.

LOST RETURN PACKAGING
If you lose the return packaging, you will be responsible for returning the item at your own expense by the expected return date and providing THE NIFTY PANTRY with a tracking number.

If you lose or fail to return THE NIFTY PANTRY delivery box, we will charge the replacement value.

LATE / NO RETURNS
By renting THE NIFTY PANTRY products you agree that product should be returned by the day after the event (or closest working day thereafter).

If you return the Products late, a daily penalty fee will be charged to the payment card you used to pay the rental fee.

If you have not returned the Product within ten (10) days after the return date your late return will be considered a non-return and THE NIFTY PANTRY will charge your payment card per item as below:

R 500 per each tablecloth or runner
R 500 per each centre piece
R 150 per each dish, plate or under plates
R 150 per each glassware
R 100 for each candle holder
R  50 per each napkin ring

MISCELLANEOUS
These Terms and Conditions and any policies or operating rules posted by us on the Site or in respect to the Site constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Terms and Conditions shall not operate as a waiver of such right or provision. These Terms and Conditions fully operate permissible by law. We may assign any or all our rights and obligations to others at any time. We shall not be responsible or liable for any loss, damage, delay, or failure to act caused by any caused beyond our reasonable control. If any provision or part of a provision of these Terms and Conditions is determined to be unlawful, void, or unenforceable, that provision or part or the provision is deemed severable from these Terms and Conditions and does not affect the validity and enforceability of any remaining provisions. There is no joint venture, partnership, employment, or agency relationship created between you and us as a result of these Terms and Conditions or use of the Site. You agree that these Terms and Conditions will not be construed against us by virtue of having drafted them. You hereby waive all defenses you may have based on the electronic form of these Terms and Conditions and use the lack of signing by the parties hereto to execute these Terms and Conditions.
